Terms and Conditions

Trailer reservations and booking requirements
Reservations are subject to trailer availability, minimum age policy, valid drivers license, tow vehicle suitability, brake controller requirements, insurance requirements, payment authorization, and signed rental agreement completion before trailer release.
Rental agreement, electronic signatures, inspections, pickup, and return
Customer must complete the rental agreement and electronic signature workflow. Pickup and return include equipment inspections, lights and connector checks, and condition documentation. Customer is responsible for lawful operation, secure loading, and return in agreed condition.
Payments, deposits, cancellations, no shows, and late returns
Zoey Transportation LLC may require payment authorization and security deposit controls where applicable. Cancellation policy, no show handling, and late return charges are governed by booking terms, rental agreement terms, and operational policies shown at booking and checkout.
Prohibited uses and operating restrictions
Prohibited uses include illegal activity, overloading, unsafe towing, off road misuse, smoking in or on equipment where prohibited, unauthorized subleasing, operation by unauthorized drivers, and any use that violates law or the rental agreement.
Damage, cleaning, missing equipment, and cost recovery
Customer is responsible for verified physical damage, missing equipment, excessive cleaning, late fees, towing or recovery expenses, and commercially reasonable administrative costs permitted by law. Chargeable items may include lost keys, missing straps, broken lights, bent ramps, bent fenders, flat tires caused by customer misuse, winch damage, electrical damage, and abandoned trailer recovery.
To the extent permitted by law, Zoey Transportation LLC may recover inspection fees, storage fees, collection costs, and attorney fees where legally allowed.
Authorization to charge payment method on file
Customer agrees that Zoey Transportation LLC may charge the payment method on file for verified damage, missing equipment, late return charges, cleaning charges, towing or recovery costs, and administrative costs permitted by law.
Accidents, breakdowns, theft, and roadside responsibility
Customer must immediately report accidents, breakdowns, theft, or impound events. Customer remains responsible for roadside safety actions and unauthorized repair costs except emergency safety measures required by law.
Indemnification, limitation of liability, and force majeure
Customer agrees to indemnify Zoey Transportation LLC for third party claims caused by customer breach, negligence, unlawful use, or misuse of equipment. Liability is limited to the maximum extent allowed by law. Zoey Transportation LLC is not liable for delays caused by weather, road closures, utility outages, or other force majeure events.
Dispute resolution and Tennessee governing law
These terms are governed by Tennessee law. Disputes will be resolved in a commercially reasonable forum with proper jurisdiction in Tennessee, subject to any mandatory legal requirements.
Eligibility, tow vehicle, and insurance
The renter and every authorized driver must meet the minimum age disclosed at booking, hold a current and valid driver’s license, and use a tow vehicle with adequate manufacturer-rated towing capacity, hitch rating, wiring, safety-chain connections, tires, and braking equipment. Where required for the selected trailer or load, a functioning brake controller is mandatory. The customer is responsible for maintaining any insurance required by law or by the rental agreement and for confirming that the customer’s policy covers the tow vehicle, trailer, cargo, drivers, and intended use.
Rental period, extensions, and late possession
The rental period begins and ends at the times stated in the reservation or signed rental agreement. An extension is effective only after written or electronic approval by Zoey Transportation LLC and payment of any additional amount required. Keeping the trailer beyond the approved return time may result in additional daily or hourly rental charges, loss-of-use charges where legally recoverable, recovery expenses, and other amounts stated in the rental agreement. Unauthorized continued possession may be treated as a material breach and may be reported to law enforcement when legally appropriate.
Condition reports, photographs, and inspections
The customer must inspect the trailer at pickup and promptly report any pre-existing damage or missing equipment. Condition reports, timestamps, photographs, video, telematics, service records, and inspection notes may be used to establish trailer condition before, during, and after a rental. Zoey Transportation LLC may inspect the trailer at pickup, return, and at other reasonable times when needed to protect safety, property, or legal rights.
Customer responsibility for loss and damage
From release until accepted return, the customer is responsible to the extent permitted by law for loss of or damage to the trailer and included equipment, regardless of whether the damage was caused by the customer, an authorized driver, cargo, another person, weather, road conditions, theft, vandalism, improper loading, overloading, misuse, or failure to secure the trailer, except to the extent caused by Zoey Transportation LLC’s proven negligence or as otherwise required by law. The customer must not arrange repairs without prior approval except for emergency actions reasonably necessary to prevent immediate bodily injury or further property damage.
Damage assessment and payment authorization
Damage and loss charges may be based on photographs, inspection records, repair estimates, invoices, replacement cost, towing or recovery invoices, diminished value where legally recoverable, and reasonable loss-of-use calculations. The customer authorizes Zoey Transportation LLC and its payment processor to charge the payment method on file for undisputed rental amounts and for documented amounts authorized by the signed rental agreement, including verified damage, missing equipment, cleaning, late return, storage, towing, recovery, impound, administrative, inspection, and collection charges to the extent permitted by law. This authorization does not waive the customer’s right to receive supporting documentation or dispute a charge in good faith.
Accidents, citations, impound, and claims cooperation
The customer must immediately stop safely, contact emergency services when required, notify Zoey Transportation LLC, obtain identifying and insurance information, preserve evidence, and cooperate with claims handling. The customer is responsible for citations, tolls, impound fees, towing, storage, and penalties arising from the customer’s possession or use, except where prohibited by law. Failure to timely report an incident or cooperate with a claim may constitute a material breach of the rental agreement.
Right to refuse, cancel, or recover equipment
Zoey Transportation LLC may refuse, suspend, or cancel a reservation or decline to release equipment when identification, payment, insurance, towing capacity, equipment condition, safety, suspected fraud, legal compliance, or availability requirements are not satisfied. Where legally permitted, Zoey Transportation LLC may recover equipment after expiration, unauthorized possession, abandonment, prohibited use, payment default, material breach, or a reasonable belief that the trailer or public safety is at risk. The customer is responsible for lawful and commercially reasonable recovery expenses caused by the customer’s breach.
Chargebacks, collections, and records
The customer agrees to first contact Zoey Transportation LLC in good faith regarding billing questions. Knowingly false or fraudulent chargebacks do not eliminate amounts lawfully owed. Zoey Transportation LLC may provide the payment processor, bank, insurer, collection provider, court, or law-enforcement agency with the signed agreement, communications, payment records, photographs, inspection reports, location records where lawfully collected, and other evidence relevant to a dispute. Unpaid amounts may be referred for collection, and the customer may be responsible for reasonable collection costs, court costs, and attorney fees only where authorized by the signed agreement and applicable law.
Website information and separate rental agreement
Website descriptions, availability, and pricing are subject to correction and final confirmation. These website Terms supplement, but do not replace, the signed rental agreement. If a conflict exists, the signed rental agreement controls for the specific rental, except where applicable law requires otherwise. No website statement modifies a signed agreement unless Zoey Transportation LLC confirms the modification in writing or electronically.
Severability, waiver, and entire agreement
If any provision is found unenforceable, the remaining provisions remain effective to the fullest extent permitted by law. A delay or failure to enforce a provision is not a waiver. These Terms, the reservation disclosures, and the signed rental agreement constitute the agreement applicable to the transaction, subject to mandatory law.
